At Lancier Monitoring GmbH we attach great value to protecting your data. This data privacy statement explains the collection, use, transmission, storage and protection of your personal data.

2. Data categories, purposes and legal bases of our data processing activities

We will process your personal data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act [Bundesdatenschutzgesetz (BDSG)] as well as all other applicable legal provisions. The scope and nature of this data processing are strictly dependent on the service or information you have selected, and the existing contractual relationship. You will find more detailed information on the data categories, processing purposes and legal bases in Part B of our Data Privacy Statement

3. Data recipients

We will transmit your personal data to the following data recipients:

  • The data transmission takes place in the fulfilment of a legal requirement in accordance with which we are obliged to report or disclose the data (e.g. to authorities).
  • The data transmission takes place to external companies which are acting as data processors on our behalf or become active on our account (this applies for example to courier and logistics companies, external computer centres, EDP and IT applications, website management, audit services, financial institutions, etc.).
  • The data transmission to third parties takes place with your consent.
  • The data transmission takes place for the performance of a contractual relationship with you pursuant to Art. 6 Para. 1. (b) GDPR.
  • The data transmission on the basis of our legitimate interests. This can be for economic, administrative or also other internal business purposes; this applies only insofar as these are not overridden by your interests or fundamental rights and freedoms which require the protection of your personal data.
  • The transmission takes place to credit agencies to access information on your credit rating.
  • The transmission takes place for the review and assertion of claims (e.g. collection companies, legal advisers)

4. Erasure of the data and duration of storage

We will process and store your data strictly only for the duration of our business relationship including the initiation and processing of the contract and the legal retention periods (e.g. under commercial or tax law).

If the data are no longer required for the fulfilment of contractual or statutory duties and rights, they are regularly erased unless their further processing is necessary – for a limited period – for the fulfilment of the aforementioned purposes out of an overriding legitimate interest.

Insofar as individual activities of processing personal data make different erasure deadlines necessary, these are mentioned in the description of the individual processing activities in Part B.

5. Hosting and data processing by third-party providers

This website is hosted by DomainFactory GmbH, Neuturmstraße 5, 80331 Munich. In this context data such as IP addresses, contact enquiries, website access and similar information are processed exclusively in computer centres within Germany. DomainFactory processes these data only within the framework of its contractual obligations and in accordance with our stipulations. To guarantee the security of your data, we have concluded a processing agreement with the hoster.

6. Processing of your data in a third country

Your data will not be transmitted to recipients in third countries outside the European Union (EU) or the European Economic Area (EEA), and there are also no plans for such transmission.

7. Data security

We use the widespread SSL procedure in combination with the respective highest level of encryption that is supported by your browser. An encrypted connection can be identified by the presence of “https://” instead of “http://” in your browser’s address line and by the lock symbol in your browser line. When the SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

8. Automated decision-making on an individual case basis / profiling

We do not use any procedures for automated decision-making or for profiling that could lead to legal effects for you or substantially affect you in a similar way.

9. Obligation to provide information

You only have to provide the information that is necessary for using the website and its functions, and for commencing and implementing a business relationship or contractual relationship with us. In some cases we are also legally obliged to collect certain information. Without this information, however, we can neither make our website available to you properly and securely, nor answer your enquiries correctly or conclude or perform a contract with you. This also applies to any information that might be required later.

10. Your rights as a data subject

Under the legal requirements, as a data subject you are entitled to the following rights which you can assert against us:

Right to be informed: Pursuant to Art. 15 GDPR you have the right to be told by us at any time whether we process your personal data. If this is the case, you can also request information about this data, such as the purposes of processing, data categories, recipients, planned storage period, origin of the data, automated decision-making and if applicable the appropriate guarantees if your data is transferred to a third country, as well as a copy of your data.

Right to rectification: Pursuant to Art. 16 GDPR you have the right to request the rectification of incorrect or incomplete personal data concerning you that we have stored.

Right to erasure: You are entitled under the requirements of Art. 17 GDPR to ask us to immediately erase the personal data concerning you. The right to erasure does not exist among other things if the processing of your personal data is necessary for exercising the right of freedom of expression and information, for the fulfilment of a legal obligation to which we are subject (e.g. statutory retention periods) or for the establishment, exercise or defence of legal claims.

Right to restriction of processing: You are entitled under the requirements of Art. 18 GDPR to request us to restrict the processing of your personal data.

Right to data portability: You are entitled under the requirements of Art. 20 GDPR to ask us to hand over to you the personal data concerning you that you provided to us, in a structured, commonly used and machine-readable format.

Right to revocation: You have the right at any time to withdraw the consent you have issued to the processing of your personal data with future effect.

Right to object: You are entitled under the requirements of Art. 21 GDPR to object to the processing of your personal data so that we must end the processing of your personal data. The right to object exists only within the limits provided for in Art. 21 GDPR. In addition, our interests may conflict with the ending of such processing, so that we are entitled to process your personal data despite your objection.

Right to lodge a complaint with a supervisory authority: You are entitled under the requirements of Art. 77 GDPR to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR. The right to lodge a complaint exists without prejudice to any other administrative or non-judicial remedy.

Nonetheless, we recommend always first directing any complaint to our Data Protection Officer.

11. Modifications

We can update this data privacy information at any time, for example if there are changes to the data processing or changes in the legal framework conditions. We will announce all modifications by publishing the updated data protection information on our website. These modifications will come into force immediately unless anything is stated otherwise. We therefore recommend that you review this data protection information regularly so that you always view the current version.

B. Processing of your data when you visit our website

1. Logging

When you use our website purely for information purposes, in other words if you do not register or transmit information to us in any other way, we collect only such data as your browser transmits to our server (in server logfiles). Every time our website is accessed by you or by an automated system, the site collects a series of general data and information. These data are stored in the logfiles on the server. The following information is collected:

  • browser types and versions used
  • the operating system used by the accessing system
  • the website from which an accessing system reaches our website (referrer site)
  • the subsites which are directed to our website via an accessing system
  • the date and time at which you accessed the website
  • an abbreviated Internet Protocol Address (anonymised IP address)
  • the Internet Service Provider of the accessing system.

The logging of the data and/or its processing in logfiles is technically essential for the proper and secure operation of the website. The legal basis for the (initial) readout of data from your end device is therefore Section 25 Para. (2) 1 TDDDG [Telecommunications-Telemedia Data Protection Act]. Insofar as  automatically transmitted data (e.g. the public IP address of your end device) are processed, this processing takes place on the basis of Art. 6 Para. 1. (b) GDPR insofar as you visit our website for purposes of the performance of a contract with you or for precontractual measures (e.g. information about our services, enquiries), as well as within the framework of our legitimate interest in accordance with  Art. 6 Para. 1. (f) GDPR. Our legitimate interest lies in the proper and secure provision of the website or our online offering.

2. Online registration for our district heating and measurement technology seminars

Within the context of seminar registration, we process the following data:

  • Name of the participants
  • Name of the person placing the order
  • Email address of the person placing the order

These data are processed and stored exclusively for the purpose of processing your seminar registration, the communication in connection with the seminar, and the technical administration. The legal basis for this is our legitimate interest in running and organising the seminars pursuant to Art. 6 Para. 1. (f) GDPR. Insofar as your registration is for the purpose of concluding a contract, then in addition Art. 6 Para. 1. (b) GDPR also serves as the legal basis for the processing.

In the event of a contract being concluded, your data will be stored for the necessary period taking account of the legal retention periods, and then erased.

3. Online job applications

4. Linking to external websites

Our website contains a link to Google Maps to offer you greater user-friendliness and additional information. Please note that the linked site is operated independently of us, and the respective operators implement the processing of your personal data there autonomously. Our Data Privacy Statement does not apply to the processing of personal data by other responsible bodies. We recommend carefully reading the data privacy statements of the respective websites. As we have no control over such processing, we are unfortunately unable to assume any responsibility for the content, uses or data privacy practices of these sites.
